As much as you might not like our server policies (which we should add was open to constructive criticism), we can't stress enough the "patent pending" warning we have plastered throughout our website and technologies. Patents are designed to grant a temporary (~20 year) monopoly to inventors to encourage innovation. However, this provides us a good opportunity to discuss the competition:

* Our in-house developed networking libraries are the only codes currently available which actually provides true "real-time" communications despite inaccurate claims and misnomers by various open source libraries such as APE. As we have obviously done our research into various alternatives prior to developing MMORPG Maker XB, it should be noted that all other libraries fall back to 5, 10, 15 second request intervals to check for new data which won't scale in an MMORPG setting, and it'll eat up bandwidth faster than you can possibly pay for it. We regularly check alternatives and competing technologies to watch for infringement so it's safe to say we still have the best solution.

* Our game engine is the only game engine that plays smoothly on mobile without unwieldy (and bandwidth heavy) techniques.

* The game you've linked will not work on lower end systems or the systems owned by the majority of the Asian market (a top, coveted MMORPG audience). If you can get it to stop lagging and freezing on these systems, you've certainly violated a patent.

While this only scratches the surface of why we have the best technology, it's not the subject of this topic, and it's more important to emphasize that our server policies are not set in stone, and in the beginning of our posts, we have made it clear we are posting the policy in order to entertain constructive criticism.

The fact is, we don't even have to advertise MMORPG Maker XB. The technology alone is enough to win us patent lawsuits (which would likely be a lot more lucrative than software sales anyway), and, truth be told, we don't care if our patents are currently being violated and we'd love to have competitors illegally use our technologies and become successful with it (see treble damages, injunction, etc.)

You certainly aren't the only one that recognizes the potential for cloud gaming, and, for years, we've been discovering (and patenting) more browser gaming technologies and techniques than any other entity. It's half our business model, and we certainly won't let others freely use our IP. The rest will be discussed with you via PM.

I dont understand what on earth this is about?

Is it because that games link is marketed as Final Fatasy?

Is that games created with this MMORPG creator? If so it is very good for a basic model!

He probably means that the creation engine (MMORPG Maker XB) is patent pending- until said patent is not only approved but the engine is also released for public use (if even then), the engine will be inaccessible and to edit any part unintended is as such a breach of the contract inherent with the purchase of the program.

Essentially, by changing the way the Maker works (using AJAX rather than the XB server) the user has created problems for himself. What kind of action the Administrator chooses to take is solely up to him, but it may (and could likely) extend to legal action, should the original poster refuse to accommodate the requirements of the Administrator. Less severely they may just revoke his permission to the program or let him off the hook this once. That's between those two.

So basically, follow this common sense principle: When using the program, don't do anything you're not supposed to.

HolmstN is correct; however, patent rights extend beyond this. In USA law, the first to invent has exclusive rights to a technology. Therefore, even if a similar invention is discovered separately and independently, the first inventor can still file for damages provided they have a patent for said invention. In the UK, EU, and several other territories, patents are on a first-to-file basis, but priority can be claimed based on the USA filing date due to international conventions.

We've been dealing with browser gaming and cloud gaming inventions and patents for the last several years now so it's safe to say we have had a strong head start even over the top commercial gaming enterprises.

Our patents and inventions extend well beyond MMORPG Maker XB, and, as stated in our "About" page, we also have developed the first multiplayer browser FPS years ago among other inventions. Patents were conceived to provide a virtual, legal monopoly as an incentive to encourage innovation. While we can obtain and abuse a monopoly, we have been more than fair to our users, and we are always trying to please our users to the best of our ability (although, we can't please everyone). A comparison I often like to make is that Adobe Flash CS5 retails for $699 USD, while our beta access is only currently $37 USD despite the fact we employ much more advanced technologies that have never been seen before and push a superior product.

With that said, we have no intention to file any lawsuits unless a violator was commercially successful and we had reasonable economic incentive to file, or if we feel it's in our strategic and competitive best interests to pursue an injunction and other remedies. This topic concerns none of that and deals with some discussions that took place in the private beta forum, and kuro has the right to his privacy, and we are currently discussing this matter over private message.
